These Terms of Service (the “Terms”) set out the conditions for use of the social media management support application (the “Service”) provided by Tagmore (the “Company”). Every person who uses the Service (a “User”) is deemed to have agreed to these Terms.

Article 1 (Definitions)

  1. Service: The smartphone application, web services, and all related services provided by the Company.
  2. User Content: Text, images, videos, data, and other material posted, uploaded, or provided by a User through the Service.
  3. Account: The ID, password, and other credentials registered by a User to access the Service.

Article 2 (Application)

These Terms apply to all matters concerning use of the Service between a User and the Company. The Company may amend these Terms at any time, and the amended Terms take effect when posted on this website.

Article 3 (Registration)

  1. A person wishing to use the Service shall apply for registration by the method specified by the Company. A service agreement is formed when the Company approves the application.
  2. The Company may refuse an application if it contains false statements or omissions, or if the applicant has previously violated these Terms, among other reasons.

Article 4 (Account Management)

  1. Users shall manage their account information at their own responsibility and shall not allow third parties to use it.
  2. All actions performed using an account are deemed to have been performed by the owner of that account.

Article 5 (Handling of User Content)

  1. Users warrant that they hold all rights required to use, publish, and distribute the User Content they post, including copyright, portrait rights, and other third-party rights.
  2. Users permit the Company to use content posted through the Service to provide, improve, and promote the Service, and grant the Company a non-exclusive, royalty-free, worldwide, sublicensable license where necessary.
  3. If the Company determines that posted content violates these Terms, it may delete or hide the content or take measures against the User, including warnings or account suspension.

Article 6 (Prohibited Conduct)

Users must not engage in any of the following conduct when using the Service:

  • Conduct that violates laws, regulations, or public order and morals
  • Conduct that infringes third-party rights, including copyrights, trademarks, and portrait rights
  • Posting false information or impersonating another person
  • Posting content that encourages crime or contains discriminatory, defamatory, obscene, or violent expression
  • Spam, excessive advertising, or unauthorized collection of personal information
  • Interference with the operation of the Company, other Users, or third-party services
  • Violating the terms of the Service or an external API, including Meta or Instagram platform policies

Article 7 (External Service Connections)

  1. The Service may provide features by connecting with external services such as Instagram, Facebook, and LINE. These connections require account authentication and permission approval for each external service.
  2. Users shall review and agree to the permissions shown on each external service's authorization screen, including OAuth screens.
  3. Users acknowledge that features may become temporarily unavailable due to changes in external API or authentication specifications.

Article 8 (Privacy)

The Company handles Users' personal information in accordance with its Privacy Policy:

Article 9 (Paid Services and Fees)

  1. Some functions of the Service may be paid. Fees are specified separately by the Company.
  2. Details regarding subscriptions, cancellation, refunds, and other matters for paid services are governed by separate paid service terms.

Article 10 (Suspension, Modification, and Termination)

  1. The Company may temporarily suspend all or part of the Service for system maintenance, operational reasons, or external factors.
  2. The Company may modify or terminate all or part of the Service after prior notice.

Article 11 (Disclaimers)

  1. The Company assumes no liability for damage incurred by a User in connection with use of the Service, except where caused by the Company's intentional misconduct or gross negligence.
  2. The Company does not warrant the accuracy of information or analysis provided through the Service or its fitness for a particular purpose.

Article 12 (Limitation of Liability)

The Company is liable only for direct and ordinarily foreseeable damages. Liability is limited to the total amount of fees paid by the User during the previous twelve months, or JPY 100,000 if no paid membership exists.

Article 13 (Copyright)

  1. Copyrights, trademarks, and other intellectual property rights related to the Service belong to the Company or their lawful owners.
  2. Users may use content provided through the Service only within the scope permitted by copyright and other laws, and may not reproduce, republish, or make secondary use of it without written permission from the Company.

Article 14 (Suspension and Registration Cancellation)

  1. If a User violates these Terms, the Company may suspend use, delete posts, cancel the account, or take other measures without prior notice.
  2. The Company assumes no liability for damages arising from those measures, except where caused by the Company's intentional misconduct or gross negligence.

Article 15 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute relating to these Terms is subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office as the court of first instance.
